Terms and Conditions for Selling Website Design & Digital Marketing Packages

Welcome to CMKC.com. These Terms and Conditions govern the sale of our website design and digital marketing services (“Services”). By purchasing any of our packages, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Introduction

CMKC.com (“we,” “our,” “us”) provides website design and development services as well as digital marketing packages. By purchasing a service package from us, you are entering into a legally binding agreement with CMKC.com.

2. Scope of Services

The details of each package are outlined in the product description and include specific deliverables such as website design, development, SEO services, social media marketing, and more, as per the package purchased. Customization of services beyond the package inclusions may be offered at an additional cost.

3. Package Pricing and Payment Terms

All prices for website design and digital marketing packages are listed on our website and are subject to change without prior notice.
Payment must be made in full at the time of purchase unless otherwise agreed upon through a custom contract.
Payments are processed securely through third-party payment gateways (e.g., WooCommerce, Stripe).
For subscription-based digital marketing services, payments will be automatically deducted on a monthly or annual basis, depending on the plan selected.
All fees are exclusive of applicable taxes, which will be added to the total amount due if required by law.

4. Refund and Cancellation Policy

Website Design Packages: Once a project has been initiated and work has commenced, refunds are not available. If the client decides to cancel the project before any work begins, a partial refund may be issued minus any administrative fees.
Digital Marketing Packages: For subscription services, you may cancel at any time. Services rendered during the current billing cycle are non-refundable. Upon cancellation, no further services will be provided, and billing will cease at the end of the current cycle.
Custom solutions and one-off digital marketing campaigns are non-refundable once initiated.

5. Project Timelines

Upon receipt of full payment or initial deposit, CMKC.com will provide an estimated timeline for the completion of services.
Timelines may vary based on client responsiveness, project scope, and complexity. Any delays caused by the client (e.g., late submission of materials) may result in a change of the estimated completion date.
For ongoing digital marketing packages, services are delivered on a month-to-month basis, with periodic updates and performance reports provided.

6. Client Responsibilities

The client must provide all necessary content (text, images, logos, etc.) required for the development of the website or execution of the digital marketing strategy.
CMKC.com is not responsible for delays caused by the client’s failure to provide required information or approval within agreed timelines.
The client is responsible for the accuracy and legality of the content provided.

7. Ownership and Intellectual Property

Upon full payment, the client will own the rights to the final website design or digital marketing deliverables (excluding third-party licensed software or tools used).
CMKC.com reserves the right to display completed projects in our portfolio for promotional purposes unless otherwise agreed upon with the client.
Any tools, templates, or licensed software used in the creation of the website remain the property of CMKC.com or the respective third-party owners.

8. Revisions and Additional Work

Packages typically include a limited number of revisions as detailed in the package description.
Additional revisions or changes outside the scope of the package will be subject to extra charges at our standard hourly rate or as agreed upon.

9. Third-Party Services

CMKC.com may integrate third-party services (e.g., hosting providers, social media platforms, analytics tools) as part of the package.
We are not responsible for any issues or downtime caused by third-party providers. Any disputes regarding third-party services must be resolved directly with the respective providers.

10. Performance and Results

While CMKC.com strives to achieve the best possible results for digital marketing campaigns, we do not guarantee specific outcomes (e.g., search engine rankings, conversion rates, traffic increases) as these are subject to various factors beyond our control.
Digital marketing results depend on various factors including competition, market trends, and client cooperation.

11. Confidentiality

Both parties agree to keep all sensitive information confidential during and after the term of the contract. This includes business strategies, proprietary information, and any non-public data.

12. Limitation of Liability

CMKC.com is not liable for any indirect, incidental, or consequential damages that may arise from the use of our services.
Our total liability in any matter related to the purchase of packages shall not exceed the amount paid by the client for the respective service.

13. Termination of Services

CMKC.com reserves the right to terminate services if the client breaches any of the terms set forth in this agreement, including but not limited to failure to make timely payments or failure to provide required information.
Upon termination, any outstanding payments for services already rendered will be due immediately.

14. Dispute Resolution

Any disputes arising from or related to the sale of packages must first be addressed through negotiation between the client and CMKC.com.
If no resolution is reached, disputes will be handled in accordance with the laws of [Your Jurisdiction] and any legal proceedings shall take place in [Your Jurisdiction’s Courts].

15. Changes to Terms and Conditions
